1. Introduction
These Terms and Conditions of
Sale apply to all purchases made from Fairnex SA through carbondriver on
any online plateform and those made in person. By placing an order, the
buyer agrees to these Terms and Conditions without limitation or
reservation, which take precedence over any other stipulations from the
purchaser. These terms are intended to inform buyers of the conditions
under which Fairnex SA, owner of carbondriver.ch, sells and delivers the
ordered products
2. Ordering Process
Once your order is confirmed,
you will receive an order confirmation via email, provided the email
address you submitted is correct. We aim to process orders promptly and
strive to deliver your products as quickly as possible.
3. Delivery Time
To offer competitive prices,
products are ordered from our suppliers upon customer purchase,
delivery times may vary depending on supplier availability. Estimated
delivery times listed on carbondriver.ch are for guidance only, and any
delays do not justify cancellation or refund requests. Delivery times
can be communicated via email upon request.
4. Delivery Terms
Our products are shipped directly from our suppliers located outside of
Switzerland. Import taxes are therefore to be expected and are
the buyer's responsibility. Delivery times vary from 1 to 6 weeks for
most products but can be longer on some orders.
Delivery is considered complete as soon as the product is made available
to the buyer. All risks associated with shipping are transferred to the
buyer upon shipment.
Receiving Procedure:
1. The buyer must inspect the goods upon receipt.
2. Any problems must be reported immediately to the carrier.
3. Specific reservations must be noted on the delivery note in the presence of
the driver.
4. Any non-conformity or defect must be reported within 5 days of receipt.
5. After this 5-day period, the goods are considered accepted.
In case of damage during transport, a formal claim must be filed with
the carrier. Without this declaration, no claim will be considered.
5. Prices
All prices are quoted in Swiss
Francs (CHF). Prices in effect at the time of order confirmation will apply. We
reserve the right to modify prices at any time without prior notice. Products
offered at discounted prices are non-returnable and non-exchangeable. All
products are new and sold in their original manufacturer's packaging, unless
otherwise stated.
6. Payment Options
carbondriver.ch offers the following payment methods:
- Credit Cards (Visa, Mastercard) – fully secured payment
7. Returns and Withdrawal
No returns are accepted for
specially ordered or promotional items. Assembled, modified, or painted
products cannot be returned. Return requests must be made in advance
through our contact form. In accordance with Swiss law, you may return a
product for exchange or refund within 7 days of receipt. The product
must be returned in perfect condition and in its original sealed
packaging. Any costs for repairs due to improper handling of the product will
be borne by the buyer. Return shipping costs are the responsibility of the
buyer. Custom-made or destocked items are non-refundable.
8. Order Cancellation
Once your order is placed, its
status can be tracked in your account. Only orders marked as
"Pending"
can be canceled or modified, and must be done by contacting us via email
as soon as possible.
9. Installation and Assembly
All products must be inspected
and adjusted before installation. For safety reasons, we highly recommend that
products be installed by a certified professional. If a defect arises
post-installation, a professional installation invoice
must be provided to validate the warranty claim. Failure to have the product
installed by a professional may void the warranty.
10. Disclaimer
The products sold on carbondriver.ch are not approved by vehicle
manufacturers or insurers. Installing these products may void your vehicle
manufacturer’s warranty and affect your insurance coverage. It
is your responsibility to notify your insurer of any modifications made to your
vehicle. carbondriver.ch assumes no liability for voided warranties, mechanical
or electronic failures, or any changes in insurance coverage resulting from the
installation of products purchased through the website.
11. Product Specifications
All technical data and certifications provided on the site are based on
manufacturer
information and relevant standards at the time of product addition. This
information is provided for reference purposes only and does not
constitute a guarantee. carbondriver.ch is not liable for typographical
errors or incorrect information.
12. Homologation and Customer Responsibility
Any homologation or
certification provided by Fairnex SA for products purchased through
carbondriver.ch and those made in person at your warehouse serves only
as an attestation that the product is designed to fit the buyer’s vehicle
model. However, it is the buyer’s sole responsibility to ensure
that the purchased items can be legally installed and used on their
vehicle according to local regulations and laws.
Fairnex SA is not responsible
for verifying the legal compliance of the buyer's vehicle modifications,
nor for ensuring compatibility between our products and any other
modifications the buyer may have made to their vehicle. If the buyer has
installed or intends to install additional modifications, it is their
responsibility to confirm that these modifications are both technically
and legally compatible with the products purchased from carbondriver.ch.
We disclaim any liability for
damages, legal issues, or non-compliance resulting from the buyer’s
other modifications or failure to ensure compatibility.
13. Limitation of Liability
carbondriver.ch is not
responsible for any direct or indirect damages, whether physical,
material, or immaterial, resulting from the use of the products sold. By
placing an order, the buyer acknowledges and accepts these Terms and
Conditions without reservation.
14. Warranties
Unless otherwise stated, no
warranties apply to the products sold. In the event of a warranty claim,
liability is limited solely to the value of the product. No
compensation for indirect or direct damages will be provided.
15. Modification of Terms
Fairnex SA reserves the right to
modify or update these Terms and Conditions at any time without prior
notice. Any changes will be effective immediately upon posting on
carbondriver.ch. It is the responsibility of the customer to review the
Terms and Conditions periodically for any updates or changes.
For orders placed prior to any
modifications, the version of the Terms and Conditions in effect at the
time the order was placed will apply. Continued use of the website or
purchases from Fairnex SA following any changes to the Terms and
Conditions signifies your acceptance of the updated terms.
16. Privacy and Data Protection
At Fairnex SA, we are committed
to protecting your privacy and ensuring that your personal data is
handled securely and in compliance with Swiss data protection laws. When
you make a purchase through carbondriver.ch or directly from our
warehouse, we collect personal information such as your name, address,

additional costs may apply.
You must also ensure that you
are available to receive the products at the delivery address provided
or make suitable arrangements. Once the goods have been delivered, you
are required to inspect them promptly for any damage or discrepancies
and report any issues within the specified time frame.
It is also your responsibility
to ensure that any products purchased from carbondriver.ch are legally
compliant and suitable for use on your vehicle, especially if you have
made or plan to make additional modifications to your car. Failure to
follow these obligations may void any rights to refunds, returns, or
warranty claims.
18. Governing Law and Jurisdiction
These Terms and Conditions are
governed by Swiss law. The competent court and jurisdiction for all
disputes arising between the parties shall be the Tribunal de Lausanne,
Switzerland.
